PART II SECURITIES AND FUTURES COMMISSION

There is hereby established a body to be known as the Securities
and

The Commission shall be a body corporate with power to sue

Subject to subsection (2), the Commission shall consist of a

《出境竹木草制品检疫管理办法》已经2003年4月3日国家质量监督检验检疫总局局务会议审议通过,现予公布,自2003年7月1日起施行。

出境竹木草制品检疫管理办法
第一章 总 则
第一条 为规范出境竹木草制品的检疫管理工作,提高检疫工作质量和效率,根据《中华人民共和国进出境动植物检疫法》及其实施条例等法律法规的规定,制定本办法。
第二条 本办法适用于出境竹木草制品(包括竹、木、藤、柳、草、芒等制品)的检疫及监督管理。
第三条 国家质量监督检验检疫总局(以下简称国家质检总局)主管全国出境竹木草制品检疫和监督管理工作。
国家质检总局设在各地的出入境检验检疫机构(以下简称检验检疫机构)负责所辖区域内出境竹木草制品的检疫和监督管理工作。
第四条 国家质检总局对出境竹木草制品及其生产加工企业(以下简称企业)实施分级分类监督管理。
第二章 分级分类管理
第五条 根据生产加工工艺及防疫处理技术指标等,竹木草制品分为低、中、高3个风险等级:
(一)低风险竹木草制品:经脱脂、蒸煮、烘烤及其他防虫、防霉等防疫处理的;
(二)中风险竹木草制品:经熏蒸或者防虫、防霉药剂处理等防疫处理的;
(三)高风险竹木草制品:经晾晒等其他一般性防疫处理的。
第六条 检验检疫机构对出境竹木草制品的企业进行评估、考核,将企业分为一类、二类、三类3个企业类别。
第七条 一类企业应当具备以下条件:
(一)遵守检验检疫法律法规等有关规定;
(二)应当建立完善的质量管理体系,包括生产、加工、存放等环节的防疫措施及厂检员管理制度等;
(三)配备专职的厂检员,负责生产、加工、存放等环节防疫措施的监督、落实及产品厂检工作;
(四)在生产过程中采用防虫、防霉加工工艺,并配备与其生产能力相适应的防虫、防霉处理设施及相关的检测仪器;
(五)原料、生产加工、成品存放场所,应当专用或者相互隔离,并保持环境整洁、卫生;
(六)年出口批次不少于100批;
(七)检验检疫年批次合格率达99%以上;
(八)检验检疫机构依法规定的其他条件。
第八条 二类企业应当具备以下条件:
(一)遵守检验检疫法律法规等有关规定;
(二)企业建立质量管理体系,包括生产、加工、存放等环节的防疫措施及厂检员管理制度等;
(三)配备专职或者兼职的厂检员,负责生产、加工、存放等环节防疫措施的监督、落实及产品厂检工作;
(四)在生产过程中采用防虫、防霉加工工艺,具有防虫、防霉处理设施;
(五)成品存放场所应当独立,生产加工环境整洁、卫生;
(六)年出口批次不少于30批次;
(七)检验检疫年批次合格率达98%以上;
(八)检验检疫机构依法规定的其他条件。
第九条 不具备一类或者二类条件的企业以及未申请分类考核的企业定为三类企业。
第十条 企业本着自愿的原则,向所在地检验检疫机构提出实施分类管理的书面申请,并提交以下资料(一式两份):
(一)《出境竹木草制品生产加工企业分类管理考核申请表》(附件1);
(二)工商营业执照复印件;
(三)企业厂区平面图;
(四)生产工艺及流程图;
(五)相应的防疫措施和质量管理的文件;
(六)检验检疫机构需要的其他资料。
第十一条 检验检疫机构自接到申请资料之日起10个工作日内,完成对申请资料的初审。
企业提交的申请资料不齐全的,应当在规定期限内补齐;未能在规定期限补齐的,视为撤回申请。
第十二条 初审合格后,检验检疫机构在10个工作日内完成对申请企业的考核。根据考核结果,由直属检验检疫局确定企业类别,并及时公布。
第十三条 有以下情况之一的,企业应当重新提出申请:
(一)申请企业类别升级的;
(二)企业名称、法定代表人或者生产加工地点变更的;
(三)生产工艺和设备等发生重大变化的。
第三章 出境检疫
第十四条 输出竹木草制品的检疫依据:
(一)我国与输入国家或者地区签定的双边检疫协定(含协议、备忘录等);
(二)输入国家或者地区的竹木草制品检疫规定;
(三)我国有关出境竹木草制品的检疫规定;
(四)贸易合同、信用证等订明的检疫要求。
第十五条 企业或者其代理人办理出境竹木草制品报检手续时,应当按照检验检疫报检规定提供有关单证。一类、二类企业报检时应当同时提供《出境竹木草制品厂检记录单》(以下简称厂检记录单)(附件2)。
第十六条 根据企业的类别和竹木草制品的风险等级,出境竹木草制品的批次抽查比例为:
(一)一类企业的低风险产品,抽查比例5%-10%;
(二)一类企业的中风险产品、二类企业的低风险产品,抽查比例10-30%;
(三)一类企业的高风险产品、二类企业的中风险产品和三类企业的低风险产品,抽查比例30-70%;
(四)二类企业的高风险产品,三类企业的中风险和高风险产品,抽查比例70-100%。
第十七条 检验检疫机构根据企业日常监督管理情况、出口季节和输往国家(地区)的差别以及是否出具《植物检疫证书》或者《熏蒸/消毒证书》等,在规定范围内,确定出境竹木草制品的批次抽查比例。
第十八条 出境竹木草制品经检疫合格的,按照有关规定出具相关证单;经检疫不合格的,经过除害、重新加工等处理合格后方可放行;无有效处理方法的,不准出境。
第四章 监督管理
第十九条 检验检疫机构对出境竹木草制品的生产、加工、存放实施全过程的监督管理。
第二十条 检验检疫机构对企业实施日常监督管理,内容主要包括:
(一)检查企业质量管理体系有效运行和生产、加工、存放等环节的防疫措施执行情况;
(二)检查企业生产、加工、存放等条件是否符合防疫要求;
(三)检查厂检记录以及厂检员对各项防疫措施实施监督的情况和相应记录;
(四)企业对质量问题的整改情况;
(五)其他应当检查的内容。
在实施日常监督管理中,检验检疫机构应当填写《出境竹木草制品监管记录》(附件3)。
第二十一条 检验检疫机构应当建立竹木草制品企业的检疫管理档案。
第二十二条 检验检疫机构对企业的分类实行动态管理,有以下情况之一的,对企业做类别降级处理:
(一)生产、加工、存放等环节的防疫措施不到位;
(二)厂检员未按要求实施检查与监督;
(三)检验检疫机构对出境竹木草制品实施检疫,连续2次以上检疫不合格;
(四)1年内出境检验检疫批次合格率达不到所在类别要求;
(五)其他不符合有关检验检疫要求的。
对做类别降级处理的企业限期整改,经整改合格的,可恢复原类别。
第二十三条 企业不如实填写厂检记录单或者伪造、变造、出售和盗用厂检记录单的,直接降为三类企业管理。
第二十四条 检验检疫机构对企业厂检员进行培训,厂检员经考核合格方可上岗。厂检员应当如实填写厂检记录单,并对厂检结果负责。
第五章 附 则
第二十五条 违反本办法规定的,检验检疫机构按照有关法律法规规定处理。
第二十六条 本办法由国家质检总局负责解释。
第二十七条 本办法自2003年7月1日起施行。
